Terms of Service
1. Overview
Welcome to Just A Premise (“I,” “me,” “my,” or “the Company”). By accessing this website or purchasing any product or service, you agree to be bound by these Terms of Service. This site offers digital creative products and writing services; all content—adult or non-adult—is fictional. Nothing here is professional advice. Users of any 18+ content certify they are 18+.
2. Eligibility
General products may be purchased by anyone. 18+ content is restricted to individuals 18+ who truthfully represent their age; I am not liable for false claims.
3. Products & Services
Digital goods include Narrative Kits, Zines, Prompt Bundles (added later), Personal Stories (read-only), and other digital creative products. Writing services include Narrative Blueprints, custom commissions, and other creative services. Digital goods: instant download. Services: delivered via email as PDF files.
4. Intellectual Property & Licensing
4.1 Personal Stories – FULL LOCKDOWN: read-only. You may NOT adapt, modify, repost, quote beyond fair use, use in audio/video, create art/fanwork/roleplay, train AI, reproduce/redistribute, create derivatives, use concepts/characters/settings/plots, or claim rights.
4.2 Narrative Kits: non-exclusive commercial rights to use prompts/ideas/structures; you may NOT resell/redistribute/repackage or claim my authorship in your final work.
4.2.1 Start Stories (Story Starters): you may continue, publish/monetize your continuation, transform characters/settings/plot direction. You may NOT republish/resell/redistribute the original starter, claim authorship of the original, publish word-for-word, or adapt without meaningful continuation—the original beginning remains mine.
4.3 Narrative Blueprints: Standard purchase grants exclusive commercial rights to use the story content; you may NOT resell the file. Upgraded purchase grants full exclusive rights including resale; after that I retain no ownership.
4.4 All Other Digital Goods: unless stated otherwise—personal use only; no commercial use; no redistribution; no derivative works; no AI training.
4.5 General Prohibited Uses: you may NOT redistribute or share purchased files, claim authorship, imply endorsement, train AI on my content, substantially mimic locked-down stories, or resell files without an upgraded license.
5. Ordering & Communication
When ordering a service: describe needs clearly; scope/details/boundaries/revision expectations must be set before work begins; revisions discussed upfront may incur fees; I may refuse/cancel/modify any order. Harassment policy: abusive/hostile behavior may result in cancellation without refund.
6. Payment Terms
Payments processed via Stripe. All sales final for digital products. Refunds for services (at my discretion): 0% started → 100% refund; light progress → up to 50%; moderate progress → up to 30%; significant progress/completed → no refund. Creative dissatisfaction is not grounds for a refund.
7. Chargebacks
Chargebacks are prohibited except for verified fraud. Unauthorized chargebacks may revoke licenses, ban purchasing, and may lead to legal action.
8. User Responsibilities
You agree not to redistribute files or share download links; not to falsely claim harm from fictional content; not to misrepresent my influence on your edits; to back up purchased files; and to acknowledge intense themes are engaged at your own discretion. Read descriptions before purchase—buying errors are not refundable.
9. Disclaimers
All stories are fictional; any resemblance is coincidental. I’m not responsible for interpretation, emotional reactions, or misunderstandings. Not liable for failed downloads, incompatibility, storage problems, or access loss by user error. Not responsible for typos unless reported within 7 days. No guarantees of publishing success, engagement, sales, reception, or outcomes. No professional advice. No future access guarantees—availability/pricing may change; access is to the file at time of sale.
10. Force Majeure
I am not liable for delays or failure to deliver due to events outside my control (illness, emergencies, outages, technical failures, disasters).
11. Governing Law
Governed by the laws of Ohio (USA). Disputes resolved in Cincinnati, Ohio, state or federal courts.
